Seller Qualification

A seller is any operator of a shop on the MakerOnline marketplace at www.makeronline.shop

Product Requirements

Exclusion Criteria

2.1 Legal Framework

Selling on our platform typically requires a business license or other official permits. It is the seller's responsibility to meet the legal requirements for online sales, particularly:

Distance and Off-Premises Contracts Act (FAGG)
Consumer Protection Act (KSchG)
E-Commerce Act (ECG)
Trade Regulation Act (GewO), if applicable

Sellers are obligated to inform themselves about these provisions and comply with them.

2.2 Admission Criteria for Sellers

Our platform is aimed at creative producers who meet the following criteria:

Production of creative and self-made goods
Production location and company headquarters in Austria
Significant involvement of the seller or their team in the production process
Authorship of the product and/or design
No infringement of third-party rights

"Self-made" products are those to which the seller or their team have substantially contributed to the creation. Mere idea generators or resellers are not permitted.

  1. Fees: Creating a shop and listing products are free. When a product is sold through the marketplace, a sales commission of 11% (plus VAT) of the net sales price is charged. Shipping costs are excluded from the commission and are not included in the calculation.

3.1. Billing Process

The commission is due as soon as the seller confirms an order. Billing occurs every 14 days and is fully automated through the Stripe.com payment system. In case of non-payment of the due invoice, MakerOnline reserves the right to temporarily suspend the seller.

  1. Shop Setup and Product Presentation

Each seller is responsible for setting up their shop and listing their products. Only one shop per seller is allowed on MakerOnline.

4.1 Required Information:

Contact and company data
Imprint (as PDF if necessary)
Own terms and conditions (as PDF if necessary)

4.2 Seller Obligations:

Regular updating of shop and contact details
No external links, email addresses, or references to other websites/online shops
Truthful and non-misleading product descriptions and images
Correct categorization of products

MakerOnline reserves the right to recategorize incorrectly categorized products without the seller's consent. MakerOnline assumes no liability for incorrect or incomplete information provided by the seller.

5.1. Pricing

All product prices must be stated including VAT (exception: exemption according to § 6 Abs. 1 Z 27 UStG)
Prices should match those in the seller's own online shop or on other platforms

  1. Sales Process and Order Processing

6.1 Contract Conclusion and Responsibilities

The purchase contract is formed directly between the buyer (registered user) and the seller
Seller bears full responsibility for production and delivery
Order and contract conclusion occur through payment via Stripe.com

6.2 Order Status and Communication

Buyer receives ongoing email updates on order status
Order status sequence: "Open" → "Confirmed" → "Shipped" (= completed)
Seller must update status immediately after shipping

6.3 Payment Processing

Seller sets payment methods in the Stripe portal

6.4 Vouchers

MakerOnline.shop currently does not offer vouchers or gift certificates

6.5 Cancellations and Warranty

Seller-side cancellations: Only through administrator (email to help@makeronline.shop)
Buyer-side cancellations: Possible until order confirmation (invoice upload)
Warranty claims: Seller is the sole point of contact
Seller must comply with legal warranty obligations

  1. Communication with Customers: Communication with customers takes place exclusively digitally. It is not permitted to pass on your own contact details (such as email address or phone number) to the buyer to process the purchase outside the marketplace. No links to other websites or online shops may be communicated. It is also forbidden to cancel the purchase in order to carry it out elsewhere.

  2. Image and Name Rights

Seller allows MakerOnline to use names, product images, and logo for marketing purposes
Image and name rights remain with the seller
Usage is limited to advertising related to the marketplace

  1. Disclaimer and Warranty

MakerOnline assumes no liability for information or products of sellers
Sellers commit to indemnify MakerOnline against third-party claims

  1. Guideline Violations and Final Provisions

Consequences for Rule Violations

MakerOnline reserves the right to suspend sellers for guideline violations
Measures are based on the General Terms and Conditions

Linguistic Equality

For reasons of readability, gender-specific formulations are omitted
All personal designations apply equally to all genders
